2ND LIFE GOODS & RUBBISH REMOVAL PTY LTD – TERMS & CONDITIONS
Acceptance of Terms
1.1 These Terms and Conditions govern all services provided by 2ND LIFE Goods & Rubbish Removal Pty Ltd (ABN: 22 661 815 630) (“we”, “us”, “our”) to you, the customer (“Customer”).
1.2 By using our services or purchasing goods, you agree to these Terms and Conditions. If you do not agree with any part of these Terms, you must not proceed with any service or purchase from 2ND LIFE.
1.3 We reserve the right to amend these Terms and Conditions at any time. Any amendments will be effective immediately upon being posted on our website or communicated to you via email. Continued use of our services constitutes acceptance of these changes.
Payment Terms
2.1 All payments for services must be made in accordance with the price list provided prior to the commencement of services. Prices for services exclude GST, while prices for goods purchased from our warehouse include GST.
2.2 Payment must be made in full at the completion of the service, unless otherwise agreed. For jobs requiring more than one truckload, payment is required at the end of each individual load.
2.3 For Goods & Rubbish Removal services that require more than 1 truckload, the customer agrees to make payment at the completion of each individual truckload before proceeding with the next load. If payment is not made at each interval, the job will be paused until payment is received, and any delays will be the responsibility of the customer.
2.4 By hiring 2ND LIFE’s services, the customer agrees with the price list previously provided and accepts that the service will take the time it requires, including any challenges faced during the job. We do not commit to specific timeframes for job completion.
2.5 Additional Charges: Some materials may incur additional charges or may be unable to be taken due to legal or safety restrictions. The customer will be informed of these potential charges prior to the job or when such materials are encountered by our team.
2.6 Dispute Over Volume: Any dispute over the estimated volume must be addressed before the job commences. Once the job begins, the customer agrees to pay based on the final volume calculated at the end of the service.
Call-Out Fees
3.1 We do not charge a call-out fee if no written estimate has been provided before the job. However, if an estimate was provided in writing prior to inspection and the customer refuses to proceed with at least the minimum estimated cost, we will charge a $150 call-out fee + GST.
3.2 Non-Removal Call-Outs: If our team arrives on-site and determines that no items are ready for removal or the items differ substantially from what was previously described, we reserve the right to charge a $150 call-out fee + GST.
Cancellations and Rescheduling
4.1 If the customer cancels the service less than 24 hours before the scheduled job, a fee of $150 + GST will be charged.
4.2 Rescheduling: Customers may reschedule their appointment at no cost if done more than 24 hours prior to the scheduled time. Any rescheduling requests within 24 hours may incur a fee.
Surcharges
5.1 Credit Card Payments: A surcharge may apply for payments made via credit card. Customers will be informed of any applicable surcharge before proceeding with payment.
5.2 Public Holiday or After-Hours Jobs: Jobs scheduled on public holidays or outside of regular business hours may incur additional surcharges. These will be communicated to the customer beforehand.
Inspection and Estimates
6.1 For Goods & Rubbish Removal services that require an on-site inspection, a quotation will be provided after the inspection. If the customer refuses to proceed after an estimate has been provided, the $150 call-out fee + GST will apply. If no estimate was provided before the inspection, no call-out fee will be charged.
6.2 Quote Validity: All quotes are valid for 14 days unless otherwise specified. Prices are subject to change without notice beyond this period. Customers are encouraged to regularly check our price list: View Price List Here.
Goods Purchases and Refund Policy
7.1 Second-Hand Goods: For any second-hand appliances and electronics bought from 2ND LIFE, customers are responsible for inspecting the items prior to purchase. If a malfunctioning item is purchased, the customer has 7 days to return the item to our warehouse for a full refund. We do not provide pickup services for malfunctioning items.
7.2 No Refund for Non-Inspected Goods: If the customer buys a product without inspecting it, they agree to accept the product as-is, and no refund will be provided unless it malfunctions within 7 days.
7.3 Returns Process: Items returned must be in the same condition as sold. Any signs of damage or misuse will void the refund. Delivery charges are non-refundable, and customers are responsible for returning items to our warehouse.
Delivery Service
8.1 Delivery Service: We provide delivery services for goods purchased.
8.2 Property and Access: If access to the delivery location is insufficient for the item being delivered, the customer can choose either:
• To have the item delivered to a ground-floor location; or
• Assume responsibility for any potential damage to the property or item in the process of attempting to deliver the item to the final destination.
8.3 Damages: 2ND LIFE is not liable for any property damage exceeding the amount of the delivery charge. The customer assumes all risks if they request delivery to a location with insufficient access.
8.4 No Fit – No Refund: If the item does not fit into the customer’s access, we can take the item back, but no refund will be given for the delivery or the item. We may leave the item on the ground floor at the customer’s request.
Service Delays
9.1 No Liability for Delays: The customer acknowledges that delays may occur due to unforeseen circumstances such as traffic, weather, or other factors. 2ND LIFE is not responsible for any inconvenience or loss resulting from these delays.
9.2 Job Duration: If a service takes longer than originally estimated, additional charges may apply. These charges will be communicated to the customer during the job.
Liability and Insurance
10.1 Insurance: We carry public liability insurance up to $20 million. However, 2ND LIFE is not liable for any loss or damage exceeding the insured amount.
10.2 Limitation of Liability: Our liability for any claim related to our services or goods is limited to the amount paid by the customer for the specific service or goods.
Hazardous Materials and Additional Items
11.1 Materials We Cannot Take: Some materials may be restricted for collection due to safety or legal requirements. Customers will be informed prior to the job or when these materials are identified by our team on-site.
11.2 Breach Fee for Hazardous Materials: If hazardous materials (e.g., asbestos) are removed without prior notification, the customer will be charged a breach fee of $300 + GST. Additional costs associated with safe disposal may also be charged to the customer.
Dispute Resolution
12.1 Any disputes arising out of or in connection with the services or goods provided by 2ND LIFE will first be attempted to be resolved through good faith negotiation. If a resolution cannot be reached, the dispute will be referred to mediation.
Intellectual Property
13.1 Copyright: Any content, materials, or designs provided by 2ND LIFE are protected by intellectual property laws. Customers may not reproduce or use these materials without prior written consent from 2ND LIFE.
Governing Law
14.1 These Terms and Conditions are governed by the laws of New South Wales, Australia, and any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
